Terms and conditions

These terms apply to the Diamond Digger game for iPhone, iPad and Android (“the game”), including the optional Remove Ads purchase, and to this website. By downloading, installing or playing the game, you agree to these terms. If you do not agree, please do not use the game. If you are under 18, please read these terms with a parent or guardian.

The short version

  • The game is free to play. You may use it for your own personal, non-commercial entertainment.
  • It shows optional reward videos and occasional ads between caves. A one-time purchase removes the ads between caves.
  • Your progress is saved only on your device, so it is lost if you delete the game.
  • Please don’t copy, resell or tamper with the game, or interfere with its ads.
  • Nothing in these terms takes away your rights under consumer protection law.

1. About us and these terms

The game is made and published by In-Detail Advertising CC (“In-Detail”, “we”, “us”), a close corporation registered in South Africa, based in Bedfordview, Johannesburg, Gauteng, South Africa. Our contact details are at the end of these terms.

Our privacy policy explains how personal information is handled and forms part of these terms.

2. Your licence to play

We give you a personal, non-exclusive, non-transferable, revocable licence to download, install and play the game on devices that you own or control, for your own non-commercial entertainment, in line with these terms and the rules of the app store you got it from. The game is licensed to you, not sold.

You may not, and may not help anyone else to:

  • copy, sell, rent, lend, distribute or publish the game or any part of it, except as the app stores’ own family sharing and usage rules allow;
  • modify, translate, decompile, disassemble or reverse engineer the game, or extract its art, music, sounds, caves or code, except to the extent the law allows despite this restriction;
  • remove or change any copyright, trade mark or other notices in the game; or
  • use the game for any unlawful purpose.

You are welcome to stream, record and share videos and screenshots of yourself playing the game, including on monetised channels, as long as you don’t suggest that we endorse you.

3. Free to play, with ads

The game is free to download and play, including every cave. It is supported by ads served by Google AdMob:

  • Reward videos are always optional. When time runs out in a cave you may watch one for 30 extra seconds, and at game over you may watch one to continue. A reward is given only when the video has been watched as required by the ad provider. Reward videos depend on an ad being available, so they may not always be offered.
  • Ads between caves appear from time to time after you complete a cave, never while you are playing.

Ads are created by third-party advertisers, not by us. We ask Google to limit them to content suitable for a general audience, but we do not control or endorse the products or services advertised, and any dealings you have with an advertiser are between you and that advertiser.

4. The Remove Ads purchase

  • Remove Ads is a one-time, non-consumable in-app purchase. It permanently switches off the ads between caves for the Apple ID or Google account that bought it. The optional reward videos stay available, so you can still choose to watch one for extra time or a continue.
  • The price is shown in the app store, in your local currency and including any taxes, before you confirm the purchase.
  • The purchase is sold and processed by Apple or Google under their terms. Payment, billing, cancellations and refunds are handled by them, in line with their refund policies and your rights under consumer law. Because the purchase is applied as soon as it completes, you may lose any right to cancel once it has been delivered, where the law allows this.
  • To use the purchase on a new or reset device signed in to the same account, open Settings in the game and tap RESTORE.
  • Purchases cannot be transferred between Apple and Google, or between different accounts.

5. Your progress

The game saves your progress, scores and settings on your device only. We do not run accounts or cloud saves for the game, so we cannot recover your progress if you delete the game, reset or lose your device, or if your device’s storage is cleared. Your Remove Ads purchase can always be restored as described above.

6. Fair play

Please don’t interfere with the game or its ads. In particular, you must not click or watch ads in a misleading or automated way, use software or devices to generate fake ad views or clicks, block or tamper with the game’s ads to obtain rewards, or try to obtain the Remove Ads purchase without paying for it.

7. Ownership and credits

The game and everything in it, including its name and logo, the character Digby, the caves, art, animation, music, sounds, text and software, are owned by or licensed to In-Detail and are protected by copyright, trade mark and other laws. All rights not expressly given to you in these terms are reserved.

The game uses the Press Start 2P typeface by CodeMan38, used under the SIL Open Font License 1.1.

Diamond Digger is an original game inspired by the classic cave-digging games of the 1980s. It is not affiliated with, endorsed by or sponsored by the owners of any other game. Any other names and trade marks mentioned belong to their respective owners.

8. Health and safety

  • Photosensitivity warning. The game contains flashing lights, explosions and fast-moving patterns. A very small number of people may have seizures when exposed to certain lights or patterns, even with no history of epilepsy. If you or anyone in your family has had a seizure or epilepsy, consult a doctor before playing. Stop playing immediately and consult a doctor if you experience dizziness, altered vision, eye or muscle twitching, loss of awareness, disorientation, involuntary movements or convulsions.
  • Take a break of 10 to 15 minutes every hour, and stop if your hands, wrists, arms or eyes become tired or sore.
  • Never play while driving, cycling, walking in traffic or doing anything else that needs your full attention.

9. Updates and availability

We may update the game from time to time to fix problems, add caves or features, or keep it working with new devices and operating systems. Some updates may be needed to keep playing. The game requires iOS 15 or later, or Android 7.0 or later, and we may change these requirements in future versions. We may also change, suspend or stop offering the game, or remove it from the app stores. If we do, you can keep playing the copy already on your device for as long as your device supports it, and your Remove Ads purchase continues to apply to it.

10. Apple, Google and other services

Your use of the App Store or Google Play, and of your Apple ID or Google account, is governed by Apple’s or Google’s own terms. Ads are provided by Google AdMob, under Google’s terms and privacy policy. These terms are between you and us only. You must also comply with any third-party terms that apply when you use the game, for example your mobile network’s terms when you use mobile data.

11. Extra terms for the App Store version

If you got the game from Apple’s App Store, Apple’s Licensed Application End User License Agreement also applies, and the following terms apply to you:

  • These terms are between you and In-Detail only, and not with Apple. In-Detail, not Apple, is solely responsible for the game and its content.
  • Your licence is limited to using the game on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the game may also be used by other accounts associated with you through Family Sharing or volume purchasing.
  • In-Detail alone is responsible for providing any maintenance and support for the game, as described in these terms and as required by law. Apple has no obligation whatsoever to provide any maintenance or support services for the game.
  • If the game fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) you paid for the game. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the game, and any other claims, losses, liabilities, damages, costs or expenses caused by a failure to meet a warranty are In-Detail’s responsibility, to the extent they are not disclaimed in these terms.
  • In-Detail, not Apple, is responsible for addressing any claims by you or any third party relating to the game or your possession or use of it, including product liability claims, claims that the game fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
  • If a third party claims that the game or your possession and use of it infringes their intellectual property rights, In-Detail, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
  • You confirm that you are not located in a country that is subject to a United States government embargo or that has been designated by the United States government as a “terrorist supporting” country, and that you are not listed on any United States government list of prohibited or restricted parties.
  • Questions, complaints or claims about the game should be sent to In-Detail using the contact details at the end of these terms.
  • Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

12. Your consumer rights and our responsibility

Nothing in these terms limits or excludes any rights you have under consumer protection law that cannot be limited or excluded, including your rights under the South African Consumer Protection Act, 2008, and, if you live in the UK or the European Union, the consumer laws of the country where you live.

Subject to that:

  • The game is free to play and is provided for entertainment. We work hard to make it fun and reliable, but we cannot promise that it will always be available, free of errors or compatible with every device, or that ads or rewards will always be available.
  • We are not responsible for loss or damage that was not foreseeable, for loss of saved progress (see section 5), for problems caused by your device, operating system, network or third-party services, or for any business losses, as the game is for personal entertainment only.
  • Our total liability to you in connection with the game is limited to the amount you paid for the Remove Ads purchase or ZAR 500 (or its equivalent in your currency), whichever is greater.
  • We do not limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence, or for anything else that the law does not allow us to limit or exclude.

13. Ending these terms

You can stop using the game at any time by deleting it from your devices. We may end your licence if you seriously or repeatedly break these terms. When your licence ends, you must stop using the game and delete it. Sections 7, 12 and 14 continue to apply after these terms end.

14. Governing law and disputes

These terms are governed by the laws of the Republic of South Africa. If you have a problem with the game, please contact us first so we can try to put it right. Any dispute that cannot be resolved informally may be brought before the courts of South Africa. If you live in another country, you also keep the protection of the mandatory consumer laws of that country and may bring proceedings in your local courts where those laws allow.

If any part of these terms is found to be unenforceable, the rest of the terms remain in force. If we do not enforce a right straight away, we can still enforce it later.

15. Changes to these terms

We may update these terms when the game, the law or our business changes. The new version will be published on this page with a new “last updated” date. Changes will not apply to a purchase you made before the change, and if a change significantly affects your rights, we will tell you in the game. If you keep playing after a change takes effect, the new terms apply.
